STATEMENT UNDER 35 U,S.C. § 21(a) AND 37 CF.R. § \M€\

Sir:

On September 13, 2001, the Director issued a notice designating the interruption in the
service of the U.S. Postal Service in the borough of Manhattan (w^hich started on September 12,
2001) as a postal service interruption and an emergency within the meaning of 35 U.S.C. § 21(a).
On September 20, 2001, U.S. Postal Service may have been restored in the area covering the
office of Kenyon & Kenyon located at One Broadway in the borough of Manhattan. As such, in
accordance with 37 CF.R. § 1.6(e), the attached correspondence is being filed promptly after the
ending of the designated interruption. The attached correspondence would have been filed on
September 15. 2001 if it were not for the U.S. Postal Service interruption and emergency.
